Deux fr\u00e8res se disputent la possession d&rsquo;une orange. Comme il n&rsquo;y en a qu&rsquo;un, la chose la plus \u00e9vidente \u00e0 faire est de le couper en deux, mais cette solution ne satisfait pas enti\u00e8rement les enfants. Ils se tournent vers leur m\u00e8re pour tenter de r\u00e9soudre le conflit. Apr\u00e8s avoir parl\u00e9 aux deux enfants, la m\u00e8re a pel\u00e9 l&rsquo;orange et a donn\u00e9 l&rsquo;int\u00e9rieur du fruit \u00e0 l&rsquo;un d&rsquo;entre eux, qui voulait le manger, et a donn\u00e9 la peau \u00e0 l&rsquo;autre, qui voulait jouer avec, en faisant des figurines. C&rsquo;est la m\u00e9diation optimale : parler, comprendre, rechercher l&rsquo;int\u00e9r\u00eat de l&rsquo;autre et trouver une solution enti\u00e8rement satisfaisante pour les deux parties.<\/span><\/p>\n<p><span style=\"color: #141f65;\">L&rsquo;utilisation du dialogue est fondamentale pour la r\u00e9solution des conflits. Par la m\u00e9diation, nous cherchons \u00e0 encourager une action coop\u00e9rative entre les parties (je gagne\/tu gagnes), en aidant les parties \u00e0 d\u00e9velopper des attitudes d&rsquo;ouverture, de compr\u00e9hension et d&#8217;empathie. Ils favorisent \u00e9galement l&rsquo;autocontr\u00f4le et l&rsquo;autor\u00e9gulation et mettent en pratique la participation d\u00e9mocratique.<\/span><\/p>\n<p><span style=\"color: #141f65;\">Le m\u00e9diateur joue le r\u00f4le de facilitateur du processus. Il s&rsquo;agit d&rsquo;un tiers neutre, expert en communication, qui cr\u00e9e l&rsquo;espace, l&rsquo;opportunit\u00e9 et les conditions pour faciliter le dialogue entre les parties afin qu&rsquo;elles parviennent \u00e0 un accord mutuellement acceptable, car, comme on le dit, \u00ab\u00a0c&rsquo;est en parlant que les gens se comprennent\u00a0\u00bb. Il s&rsquo;agit essentiellement de donner une chance au dialogue.<\/span><\/p>\n<p><span style=\"color: #141f65;\">Face \u00e0 des situations difficiles, conflictuelles, aggravantes &#8230;. \u00e0 la demande des parties, le m\u00e9diateur se met au milieu des parties concern\u00e9es afin de les aider, par des techniques de communication, \u00e0 d\u00e9couvrir leurs int\u00e9r\u00eats, leurs besoins, et ainsi, en essayant de satisfaire les int\u00e9r\u00eats de chacun, de pouvoir avancer dans une relation bas\u00e9e sur le respect et la reconnaissance mutuelle des parties.<\/span><\/p>\n<p><span style=\"color: #141f65;\">La m\u00e9diation est une proc\u00e9dure volontaire de r\u00e9solution des conflits, alternative \u00e0 la proc\u00e9dure judiciaire, dans laquelle les parties demandent et acceptent l&rsquo;intervention de m\u00e9diateurs professionnels, impartiaux et neutres qui ne sont pas habilit\u00e9s \u00e0 prendre des d\u00e9cisions \u00e0 leur place. La m\u00e9diation aide \u00e0 trouver une r\u00e9ponse utile au conflit et facilite l&rsquo;approche des besoins r\u00e9els des personnes. Les parties restent ma\u00eetres des n\u00e9gociations et du litige.<\/span><\/p>\n<p><span style=\"color: #141f65;\">Dans la m\u00e9diation, les personnes en conflit ne d\u00e9l\u00e8guent pas leur pouvoir de d\u00e9cision \u00e0 un tiers (soit un juge, un arbitre, etc&#8230; qui se situe \u00e0 un niveau sup\u00e9rieur \u00e0 celui des parties, structure triangulaire) mais ce sont les parties elles-m\u00eames qui \u00e9tablissent les accords et ceux-ci seront le reflet de leur volont\u00e9. Les accords ont plus de chances d&rsquo;\u00eatre respect\u00e9s parce qu&rsquo;ils sont le r\u00e9sultat d&rsquo;une d\u00e9cision personnelle des parties, une d\u00e9cision qui a g\u00e9n\u00e9r\u00e9 l&rsquo;obligation ou l&rsquo;engagement. La m\u00e9diation sera possible si les parties acceptent de coop\u00e9rer avec les m\u00e9diateurs pour r\u00e9soudre le conflit, de se respecter mutuellement pendant et apr\u00e8s le processus, et
